"Is a digital signature valid in India?" has three answers, because the phrase covers three different things. The Information Technology Act, 2000 recognises electronic signatures as equivalent to handwritten ones — but only certain kinds, for certain documents.

When each is required
DSC (Class 3)
- Every MCA filing by a company/LLP director (DIN-linked).
- GST returns and registration for companies and LLPs (proprietors can use EVC/OTP instead).
- Income-tax returns where audit is applicable (ITR-3/5/6 with audit), and all company returns.
- Government e-procurement (GeM bids above thresholds, state tenders), DGFT/IEC, trademark e-filing by agents.
- Signing e-invoices via certain integrations (though IRP-signed invoices don't need your DSC).
Since 2021 only Class 3 is issued; Class 2 was discontinued. Get one with signing + encryption if you bid on tenders.
Aadhaar eSign
Good enough — and legally solid — for almost everything commercial:
- Employment contracts, offer/experience letters, NDAs
- Vendor agreements, service contracts, SOWs
- Rent and leave-and-licence agreements (registration still needed where the state requires it)
- Loan and KYC documents (banks use it daily)
Platforms: Leegality, SignDesk, Digio, Zoho Sign, DocuSign (with Aadhaar), and the government's own eSign on DigiLocker for many forms.
Signature image
Fine for documents where the question "did you really sign this?" will never be litigated — quotations, internal approvals, thank-you letters, a stamped invoice copy. Draw or type one with the digital signature maker and place the transparent PNG on the letterhead, quotations or HR letters. Just know it carries no more weight than a scanned signature.
What the IT Act excludes
Electronic signatures of any kind are not valid for: negotiable instruments (except cheques), powers of attorney, trusts, wills, and contracts for sale of immovable property. Those still need wet ink (and often registration).
Stamp duty still applies
An eSigned agreement still needs the correct stamp duty; most eSign platforms integrate e-stamping (SHCIL/state portals). An unstamped contract is admissible only after paying duty and penalty.
Practical setup for a small business
- Proprietor: no DSC needed for GST/ITR (use Aadhaar OTP/EVC). Get one only if you bid on tenders.
- Company/LLP: every director/partner who signs filings needs a Class 3 DSC; renew before expiry (filings fail silently otherwise).
- Use an eSign platform for contracts — ₹20 per signature is cheaper than one dispute.
- Keep a signature PNG for everyday documents; never share the file publicly.
- Store signed PDFs with their audit trail (eSign platforms provide it) for the document's retention period.
FAQ
Is a WhatsApp "OK" a valid acceptance of a contract?
Courts have treated messages as evidence of agreement in some cases, but it is weak proof. Use eSign for anything with money attached.
Can I use DocuSign without Aadhaar?
Yes; "simple" e-signatures are valid under Section 10A of the IT Act between consenting parties, but Aadhaar eSign or DSC gives stronger evidentiary presumption.
How long does a DSC take?
Same day with video KYC from most CAs; the token is couriered or downloaded to a token you already own.
Is a signature typed in a cursive font legally a signature?
Only as much as any image — it shows intent but doesn't authenticate identity. Use it for low-stakes documents.
